USER LICENSE AGREEMENT

 

 GRAPHIC ASSETS LICENSE OVERVIEW

This license refers to the use of vintage voyage design supply software tools and stock graphics including digital brushes, actions, graphic, effects, CREATORS, vector files and texture images (collectively "Graphic Assets").


END USER

Individuals, freelancers, creative agencies and organizations with less than 100 million USD in annual revenue. 


NUMBER OF USERS

The number of users allowed is equal to the quantity chosen at the time of purchase, displayed on your receipt as the product quantity.

Devices: Each user can install or use the Graphic Assets on up to two devices for use by the same user

(e.g. a desktop at the studio and a laptop or iPad for home or travel).


ALLOWED USES

✔  Print and digital publishing projects including comics, book covers, magazines, editorial illustrations and picture books.

✔  Music packaging in physical and digital formats.

✔  Social media content for personal, company and client use.

✔  Branding, logos, stationery, posters and signage.

✔  Creation of digital stock illustration & photography.

✔  Art projects and personal work.

✔  Physical end products offered for sale such as homewares, apparel, product packaging, art-prints, greeting-cards, posters, etc (up to 500 units).

✔  Video advertising (up to 100,000 lifetime views).

✔  Use in broadcast, film and streaming content (up to 100,000 lifetime views).

✔  Print and outdoor advertising (local & national campaigns).

✔  Desktop web and mobile applications (single app).


USES REQUIRING AN EXTENDED LICENSE

  Use by organizations or subsidiaries thereof with annual revenue of more than $100 million USD.

  Global or international print advertising campaigns.

  Embedding in create-on-demand or design-it-yourself software or services (individuals selling finished artwork or products for sale on print-on-demand sites OK).

  Any use over the limits described in the Allowed Uses section above.

USES NOT PERMITTED 

✘  Sub-licensing, resale, sharing, transfer or redistribution either for free or payment.

✘  Installation into apps other than the app the Graphic Assets are designed for.

✘  Distribution via any physical or internet-connected storage device, cloud service or file-sharing website either for free or payment.

✘  Reverse-engineering and/or use of a True Grit product to create a similar product offered for free or for sale.

FONT LICENSE OVERVIEW


END USER

Our commercial font license covers the use of our fonts by individuals, freelancers, creative agencies and organizations with less than 100 million USD in annual revenue.


NUMBER OF DESKTOP USERS

The number of desktop users allowed to install and use a purchased Font is equal to the quantity chosen at the time of purchase and displayed on your receipt. When purchased as part of a multi-product bundle the Font is licensed for use by up to 3 desktop users.


ALLOWED USAGE 

✔  Print publishing projects, flyers, posters, etc.

✔  Music, Audio and Podcast packaging in physical and digital formats.

✔  Branding, logos, stationary, signage (font must be outlined).

✔  Self-promotion, social media content.

✔  Art projects and personal work.

✔  Digital banner advertising.

✔  Use on websites using the @font-face selector up to the monthly pageview limits specified on your receipt.

✔  Physical end products offered for sale such as homewares, apparel, product packaging, art-prints, greeting-cards, posters, etc (up to 50,000 units).

✔  Content and titles for broadcast, film and streaming services (up to 100,000 lifetime views).

✔  Video advertising (up to 100,000 lifetime views).

✔  Print and outdoor advertising (local & national campaigns).

✔  E-publications (read-only up to 100,000 combined units).


USES REQUIRING AN EXTENDED LICENSE

•  For use by organizations or subsidiaries thereof with annual revenue of more than $100 million USD

•  Global or international advertising campaigns (print & broadcast).

•  Use in print-on-demand or design-it-yourself software or services.

•  Any use exceeding the limits described in the Allowed Uses section above.


USES NOT PERMITTED 

✘  Sub-licensing, resale, sharing, transfer or redistribution either for free or payment.

✘  Use in alphabet or letterform products consisting of individual letterforms such as alphabet stickers or rubber stamps.

✘  Linking or embedding of desktop OTF font files on any website.

✘  Embedding in software, applications or electronic devices.

✘  Embedding in website templates or document templates.

✘  Trademarking of logos created with a purchased Font.

PERSONAL USE LICENSE


What does "personal use" mean?

Personal, or Non-commercial, use is a use for solely personal purposes. For a use to be considered “Personal” it must meet ALL THREE of the following:

• The use must not involve an exchange of money

• The use must not promote a business entity (this includes non-profit organizations)

• The use must not directly or indirectly result in financial gain


Can I still create physical or digital End Products with a Personal license?

Yes, you may create physical end products for Non-Commercial Use, not for resale or wholesale, such as, but not limited to: clothing, cards, invitations, stickers, etc.

Yes, you may create product packaging for Non-Commercial Use, such as, but not limited to: labels, stickers, containers, etc, for any number of separate end products.

Yes, you may create digital products for Non-Commercial Use, such as, but not limited to: static designs, static website elements, etc.

Yes, you may create digital or Print Publication for Non-Commercial Use, such as, but not limited to: cards, invitations, photo albums, scrapbooks, ebooks / e-publications


Does a Personal License allow me to create posts for a social media account?

Yes, you may use assets purchased with a personal license for one personal or individual social media account for Non-Commercial use. You may not use it on a social media account that forwards a company or business.


Can I use a personal license for Streaming of Motion Picture and Audiovisual Content?

Yes, internet streaming of minor motion picture and audiovisual works is permitted for Non-Commercial use only (e.g. Youtube, Vimeo, etc). There is no limit on lifetime viewers for Non-Commercial use.

✘ Audio-Visual Advertisements are considered Commercial Use and are not permitted.

✘ No, internet streaming for Commercial use is not permitted.

✘ No, use of an Asset in major broadcast productions is not permitted for Commercial and Non-Commercial Use. This includes via network / cable TV, satellite, pay-per-view, video/audio on demand.


Can I use a Personal License to create an E-Book?

Yes, you may use the Licensed Asset in digital or print publications such as cards, invitations, photo albums, and scrap books, e-books or e-publications, that are for Non-commercial use only.


Can I use licensed Assets for my non-profit organization or charity with a Personal License?

If your use of the licensed Asset results in indirect or direct monetary gain (e.g. donations, etc) this would be considered Commercial Use, and a Personal License would not allow it.

For the purpose of our licenses, non-profit does not necessarily equate to personal use. Please see our License Page for more information on how Personal and Commercial Use are defined.


What is not allowed by the Personal License? 

These are not permitted under the Personal License:

✘ Commercial Use

✘ Use in-demand applications, like Print-on-Demand and Create-on-Demand Services, even for non-commercial use

✘ Use in software development, such as website software development, mobile app development, desktop application development, or video game development

✘ Use in physical (printed, paid or unpaid) advertising, such as billboards, signage, printed advertisement, etc. This is prohibited for Commercial use AND Non-commercial use.

✘ Part of a trademark, service mark, design mark, trade name, business name, logo, or similar use.

✘ Claim the Licensed Asset itself as its own copyrighted work.

✘ Trademark an End Product. The Licensed Asset may not be used as part of a trademark, service mark, design mark, or trade-name. You may not register, protect, or enforce any trademark or similar rights on the Licensed Asset.

✘ Copyright a Licensed Asset. You may not claim a Licensed Asset (or a modification of it) as its own copyrighted work. You must disclaim the original Licensed Asset in any copyright registration.
